ਪੰਜਾਬ ਅਤੇ ਹਰਿਆਣਾ ਹਾਈ ਕੋਰਟ ਨੇ ਚੰਡੀਗੜ੍ਹ ਪ੍ਰਸ਼ਾਸਨ ਅਤੇ ਅਧਿਆਪਕਾਂ ਵਿਚਕਾਰ ਲੰਬੇ ਸਮੇਂ ਤੋਂ ਚੱਲ ਰਹੇ ਵਿਵਾਦ ‘ਤੇ ਫੈਸਲਾ ਸੁਣਾਇਆ ਹੈ। ਇਹ ਮਾਮਲਾ ਅਧਿਆਪਕਾਂ ਦੀ ਸੇਵਾਮੁਕਤੀ ਦੀ ਉਮਰ 58 ਸਾਲ ਹੋਣੀ ਚਾਹੀਦੀ ਹੈ ਜਾਂ 65 ਸਾਲ ਨਾਲ ਸਬੰਧਤ ਸੀ। ਅਦਾਲਤ ਨੇ ਸਪੱਸ਼ਟ ਕੀਤਾ ਕਿ ਅਧਿਆਪਕਾਂ ਦੀ ਤਰਜੀਹ 65 ਸਾਲ ਨੂੰ ਲੈ ਕੇ ਸੀ। ਅਦਾਲਤ ਨੇ ਸਪੱਸ਼ਟ ਕੀਤਾ ਕਿ ਅਧਿਆਪਕਾਂ ਨੂੰ 65 ਸਾਲ ਦੀ ਉਮਰ ਤੱਕ ਸੇਵਾ ਵਿੱਚ ਰਹਿਣ ਦਾ ਲਾਭ ਮਿਲੇਗਾ, ਜਿਵੇਂ ਕਿ ਪਹਿਲਾਂ ਜੋਗਿੰਦਰ ਪਾਲ ਸਿੰਘ ਕੇਸ ਵਿੱਚ ਨਿਰਧਾਰਤ ਕੀਤਾ ਗਿਆ ਸੀ।

ਇਹ ਵਿਵਾਦ ਉਦੋਂ ਪੈਦਾ ਹੋਇਆ ਜਦੋਂ ਕੇਂਦਰੀ ਪ੍ਰਬੰਧਕੀ ਟ੍ਰਿਬਿਊਨਲ ਨੇ 21 ਮਾਰਚ, 2023 ਨੂੰ ਹੁਕਮ ਦਿੱਤਾ ਕਿ ਅਧਿਆਪਕਾਂ ਨੂੰ 65 ਸਾਲ ਦੀ ਉਮਰ ਤੱਕ ਸੇਵਾ ਵਿੱਚ ਰਹਿਣ ਦਾ ਅਧਿਕਾਰ ਹੈ। ਚੰਡੀਗੜ੍ਹ ਪ੍ਰਸ਼ਾਸਨ ਨੇ ਇਸ ਹੁਕਮ ਨੂੰ ਹਾਈ ਕੋਰਟ ਵਿੱਚ ਚੁਣੌਤੀ ਦਿੱਤੀ। ਪ੍ਰਸ਼ਾਸਨ ਨੇ ਦਲੀਲ ਦਿੱਤੀ ਕਿ ਜਗਦੀਸ਼ ਪ੍ਰਸਾਦ ਸ਼ਰਮਾ ਬਨਾਮ ਬਿਹਾਰ ਰਾਜ (2013) ਵਿੱਚ ਸੁਪਰੀਮ ਕੋਰਟ ਦਾ ਫੈਸਲਾ ਸਹੀ ਢੰਗ ਨਾਲ ਲਾਗੂ ਨਹੀਂ ਕੀਤਾ ਗਿਆ ਅਤੇ 58 ਸਾਲ ਦੀ ਸੀਮਾ ਹੀ ਇੱਕੋ ਇੱਕ ਵੈਧ ਸੀ।

ਅਧਿਆਪਕਾਂ ਨੇ ਦਲੀਲ ਦਿੱਤੀ ਕਿ ਉਨ੍ਹਾਂ ਨੂੰ ਉਨ੍ਹਾਂ ਦੇ ਸਾਥੀਆਂ ਵਾਂਗ ਹੀ ਲਾਭ ਮਿਲਣੇ ਚਾਹੀਦੇ ਹਨ, ਜਿਨ੍ਹਾਂ ਨੂੰ ਪਹਿਲਾਂ ਹੀ 65 ਸਾਲ ਦੀ ਉਮਰ ਤੱਕ ਸੇਵਾ ਕਰਨ ਦਾ ਅਧਿਕਾਰ ਹੈ। ਕੁਝ ਅਧਿਆਪਕਾਂ ਨੂੰ 65 ਸਾਲ ਤੱਕ ਕੰਮ ਕਰਨ ਦੀ ਇਜਾਜ਼ਤ ਦੇਣ ਜਦੋਂ ਕਿ ਕੁਝ 58 ਸਾਲ ਦੀ ਉਮਰ ਵਿੱਚ ਸੇਵਾਮੁਕਤ ਹੋ ਜਾਂਦੇ ਹਨ, ਪੱਖਪਾਤੀ ਅਤੇ ਕਾਨੂੰਨ ਦੀ ਭਾਵਨਾ ਦੇ ਵਿਰੁੱਧ ਹੋਵੇਗਾ।
